Abstract

Over the past few years, the introduction of digital technologies into various areas of governance has accelerated markedly. The development and improvement of the legal framework governing international cooperation among the BRICS countries on cross-border gathering of electronic evidence is of strategic importance in combating transnational IT crime, which poses a threat to their economic and national security. This article examines legal mechanisms for crossborder access to and collection of electronic evidence in criminal proceedings in the light of China’s experience, and on this basis proposes ideas for standardizing a single cooperation mechanism responding to requests for mutual legal assistance in cross-border access to electronic evidence within the BRICS. These issues are crucial for the detection, investigation and prosecution of offences and for identifying priority directions for further research in this field.
